Reading the first interview in the pdf with Space Gamer, Dave was a shareholder which made him a partner in the entire thing. Gary was also subject to the same work for hire rules that everyone else was. That's why he lost control over Greyhawk when he was ousted. He still got royalties on product sold for it along with the rules for Basic/AD&D. See page 9 of the pdf for the actual contract between Gary and Dave over D&D showing the work for hire for both of them. Yeah, that work for hire provision bit Gary hard later on. Good lesson there, if you are a creative person and you want to form a company, retain personal copyrights and trademarks and license them to the company you create for a set length of time, if you get ousted later on, you or your heirs will get it all back when the licensing agreement runs out.

Gygax was nuts, why would he want to be a work for hire employee for TSR. If I started a company, I would never be a work for hire employee of my own company. I would want to license my work to my company. Once it started making money, send a lot of my pay into a trust or something.

I agree, I can understand why Gygax would want everyone else to be work for hire. But am amazed that he was willing to be work for hire himself. Why would anyone want to be work for hire when doing creative work?
